New labor laws shift pay schedule for some BCPS employees One-year transition on pay dates

Burke County Public Schools is preparing to implement new federal regulations under the Fair Labor
Standards Act regarding certain exempt employees. These new rules from the Department of Labor take effect
July 1, and a few employees may be reclassified as non-exempt and move from salary to hourly pay. Burke County Public Schools will be notifying any affected employees of this change.

In addition to these new regulations, the Fair Labor Standards Act requires employers to pay for time worked during a particular pay period. Thus, rather than paying in advance, Burke County Public Schools employees who are non-exempt under the Fair Labor Standards Act will need to be paid for time worked “in arrears” going forward. These employees will continue to receive compensatory and/or overtime as they always have.

To allow employees time to adjust, Burke County Public Schools will not implement this change until August of 2025. Beginning in August of 2024, BCPS will hold information sessions regarding this adjustment with affected employees to be ready for the change in August 2025.
