Response to Federal Policy Changes
Dear BCPS Families,
Under U.S. law, all children—regardless of their immigration status—have the right to a public education.
However, recent federal policy changes have removed previous guidance that discouraged immigration enforcement actions in schools. U.S. Immigration and Customs Enforcement (ICE) now has the authority to conduct enforcement actions—including arrests, interviews, and document requests—on school property.
We know these recent changes may bring uncertainty and concern to many of our families, staff, and fellow community members. As we work to understand these changes, what has not changed is Burke County Public Schools’ All-In Promise of Academics for All, All-around Well-Being and All Schools Connected to the Community.
Burke County Public Schools is All-In on providing every student with a safe, welcoming, and supportive learning environment. Every child has the right to a quality education, and we will continue to follow our safety protocols, district policies, and state and federal laws that protect our students' rights and well-being.
Our Commitment to Students and Families
Student Safety and Privacy Are a Priority. Student records and personal information are protected under the Family Educational Rights and Privacy Act (FERPA). We will not share confidential student information with immigration officials unless legally required to do so, such as by a court-ordered warrant. We are required to comply with and follow all state and/or federal laws as well as lawful orders from law enforcement.
Support for Students Will Not Change. Schools should be a place where students feel secure, encouraged, and empowered. We will continue to provide academic, social, and emotional support to help every student succeed.
How Schools Will Respond to ICE Visits:
- School officials will ask ICE officers for legal documentation, including warrants. There are two types of warrants:
- Administrative warrants are issued by ICE and do not grant officials access to student records.
- Judicial warrants are signed by a judge and may require compliance. Schools will notify families before releasing any information whenever possible.
- If an officer attempts to access a student, school leaders will tell ICE that they cannot give permission or parental consent and they will notify the superintendent and legal counsel. However, please note that if any law enforcement officer, including ICE, commands a school employee to produce a student the employee will comply.
- Parents will be contacted if enforcement actions involve their child.
- Schools will work to minimize disruptions and ensure students feel safe.
